Data Privacy

Data Privacy

1. Information about the collection and processing of personal data and the person responsible for the data processing.

1.1 In the following, we inform you about the collection of personal data when using this website. Personal data is all data that can be personally attributed to you, e.g. your name, your address, your date of birth, your email address and your user behavior.

1.2 If the processing of your data is necessary, it is always carried out in accordance with the data protection regulations of the German Federal Data Protection Act (BDSG) in the version applicable since May 25, 2018 and the EU General Data Protection Regulation (DS-GVO), as well as the principles stated here. In some cases, we use external service providers called order processors (cf. Article 4 number 8, Articles 28 and 29 DS-GVO) - insofar as this is permissible according to the aforementioned regulations - to process your data. These order processors have been carefully selected and commissioned by us, are bound by our instructions, and are regularly monitored.

1.3 The responsible party according to Article 4 number 7 DS-GVO is ASS Elektronik GmbH, Maybachstraße 14, 67269 Grünstadt. (See also “Imprint”) You can reach our data protection officer by mail at the above postal address (Please write "attn. data protection officer" on the envelope.) or by e-mail at Datenschutz@~@ass-gmbh.com.

1.4 The data protection officer who can be reached via the contact details above also acts as the joint data protection officer of the ASS group of companies for our German subsidiary AFS ASS Field Service GmbH in accordance with Article 37 (2) of the GDPR.

2. Your rights

2.1 You have the following rights with respect to your personal data:

  • the right of access,
  • the right to correction or deletion,
  • the right to restrict processing,
  • the right to object to processing,
  • the right to data portability.

2.2 If you have any questions regarding the processing of your personal data or the assertion of your rights, please contact us by e-mail at Datenschutz@~@ass-gmbh.com or in writing to the postal address mentioned in section 1.3.

2.3 You have the right - without affecting any other administrative or judicial remedy - to lodge a complaint about the processing of your personal data by us with the responsible data protection supervisory authority pursuant to Article 77(1) DSGVO. The supervisory authority of the state of Rhineland-Palatinate that is responsible for ASS Elektronik GmbH is:

The State Commissioner for Data Protection and Freedom of Information, Prof. Dr. Dieter Kugelmann.
Hintere Bleiche 34
55116 Mainz
E-Mail: poststelle@~@datenschutz.rlp.de

3. Collection of personal data for informative usage
3.1 When using the website for information purposes only, i.e. when you do not otherwise communicate information to us, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis Article 6(1)(f) DS-GVO):

  • IP address
  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred in each case
  • Website from which the request comes
  • Browser
  • Operating system and its interface
  • Language and version of the browser software.

Storage of the IP address, at least for a short time, is a technical necessity due to the way the Internet works. However, the IP addresses are made into pseudonyms before any processing occurs; for this purpose, the last part of the IP address is changed. The data is only processed further in this anonymous form. The original IP addresses are not stored or processed. Conclusions about the original IP addresses or their assignment to you as an individual are therefore not possible.

3.2 In addition to the previously mentioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive, assigned to the browser you are using, and through which the entity that establishes the cookie (in this case us) receives certain information. Cookies cannot execute programs or transfer viruses to your computer. They are used to make what the Internet has to offer more user-friendly and more effective overall.

3.3 Use of cookies:

3.3.1 This website uses the following types of cookies, the scope and functionality of which are explained below:

- Transient cookies (see 3.3.2 and 3.3.3 for details).
- Persistent cookies (see 3.3.4 and 3.3.5).

3.3.2 Transient cookies are automatically deleted when you close the browser. These include, in particular, session cookies. These store what is called a session ID, with which various requests from your browser can be assigned to a common session. This allows your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.

3.3.3 Integration of the videolyser.de video

We have integrated a video into the career offer section of our website; it is stored with the German-based provider videolyser.de and can be played directly from our website.
A session cookie called "PHPSESSID" is required to play the video. This retains the user's status for all page requests. The session cookie is deleted when you log out or close the browser.

Videolyser.de does not receive any data from you that can be used to establish a personal reference, since your IP address is made anonymous before it is stored in the server log files of videolyser.de. This means that the last part of your actual IP address is replaced by a random number. At the web server level, this is done by storing an IP address 123.123.123.XXX in the log file by default instead of the visitor's actual IP address, e.g. 123.123.123.123, where XXX is a random value between 1 and 254.

3.3.4 Persistent cookies are automatically deleted after a specified period of time, which may differ depending on the cookie. You can go into your browser’s security settings and delete the cookies at any time.

3.3.5 When you first access our website, we use a cookie banner to inform you about the use of cookies and your rights, which are outlined and explained in our privacy policy.

3.3.6 You can configure your browser settings according to your preferences and, for example, refuse to accept third-party cookies or all cookies. We would like to point out, however, that you may then not be able to use all functions of this website.

3.4 We store this information separately from any further data that may be provided to us. In particular, the data from cookies will not be linked to your other data.

4. Further website functions and offers

4.1 In addition to the purely informational use of our website, we offer various services that you can use if you are interested. For this purpose, it is usually necessary for you to provide additional personal data, which we then use to provide the relevant service.

4.2 When you contact us by e-mail, we store your e-mail address and, if you provide it, your name in order to answer your specific inquiry. We delete the data accruing in this context when the respective inquiry has been conclusively processed or restrict the processing if there are statutory retention obligations. The legal basis for the processing of this data is Article 6(1)(b) DS-GVO.

5. Data protection in relation to applications and the application process as well as legal basis/framework for data processing

5.1 If you make use of the option to apply for a job with us online, by e-mail or by other means (e.g. by mail), we will process the personal data you provide on the application form and any PDF attachments (i.e. your contact data as well as the information you provide relating to your qualifications if you submit a resume and references in connection with your application) to the extent that is necessary to carry out the application process. After transmission, the data contained in your PDF attachments is sent directly to the server of our external service provider via an encrypted connection. All data is encrypted. The legal basis for this type of processing is Section 26 of the German Federal Data Protection Act (BDSG) in conjunction with Article 88 of the German Data Protection Regulation (DS-GVO).

5.2 Unless the application has led to employment with us or you have given your explicit consent to do otherwise, all personal data collected for the purposes of an application procedure will be further processed for a maximum of three months after the conclusion of the application procedure and then deleted, insofar as no other legitimate interests of the party responsible for the processing conflict with such deletion. A legitimate interest in this sense may be based in particular on an obligation to provide evidence in proceedings under the General Equal Treatment Act (AGG). The legal basis for the continuation of processing in this case is Article 6(1)(f) DS-GVO.

5.3 No automated decisions on individual cases as defined in Article 22 DS-GVO take place, i.e. the decision about your application is not based exclusively on automated processing.

6.  Objection to or revocation of the processing of your data

6.1 If you have given your consent to the processing of your data, you can revoke this consent at any time. Should you wish to do so, please contact our data protection officer (for contact details, see section 1.3 of this data protection declaration); you do not need to use any special form or method for the withdrawal of your consent. Such a revocation will affect the lawfulness of the further processing of your personal data for the future; the legality of the previous processing of your personal data remains unaffected.

6.2 Insofar as we base the processing of your personal data on a balance of interests, you may object to the processing. This applies in particular when the processing is not necessary in order to fulfill a contract with you, as presented in the description of each position and offer on our website. When exercising such an objection, we request that you explain the reasons why your personal data should not be processed in the manner carried out by us. In the event that your objection is well founded, we will review the situation and either discontinue/adjust the data processing or inform you of our compelling legitimate grounds for continuing the processing.

7.  Data security

We employ up-to-date technical measures to ensure data security, in particular to protect your personal data from risks during data transmission and to prevent third parties from acquiring information. These measures are continually adapted to ensure that they reflect the current state of the art.

8.  Target groups
8.1 Our website (in particular our job offers) is generally aimed at adults. Persons under the age of 16 may not transmit any personal data to us without the consent of the bearer of parental responsibility (cf. Article 8 (1) DS-GVO).

8.2 Our range of products and services is geared towards the b2b (business-to-business) sector and is therefore aimed exclusively at business customers, i.e. companies as defined by Section 14 of the German Civil Code (BGB) and not consumers (cf. Section 13 BGB).
